Terms & Conditions

Registration and use of the website

Only registered users may order Goods on the Website.
To register as a user, you must provide a unique username and password. You will need to use your unique username and password to access the Website in order to purchase Goods.
You agree and warrant that your username and password shall:
be used for personal use only; and
not be disclosed by you to any third party.
For security purposes you agree to enter the correct username and password whenever ordering Goods
You agree to notify Global Unique Fabrics immediately upon becoming aware of or reasonably suspecting any unauthorized access to or use of your username and password and to take steps to mitigate any resultant loss or harm.
Prior to delivery or your collection of the Goods, you may cancel an order at any time provided you do so before receiving a dispatch or delivery notice. After delivery or your collection of the Goods, you may return the Goods only in accordance with the Returns Policy.
Placing Goods in a shopping basket without completing the purchase cycle does not constitute an order for such Goods, and as such, Goods may be removed from the shopping basket if, stock is no longer available or the price thereof might change without notice to you.
You acknowledge that stock of all Goods on offer is limited and that pricing may change at any time without notice to you. Global Unique Fabrics, will take all reasonable efforts to monitor stock levels and ensure that when stock is no longer available, that offers thereof are discontinued on the Website. However, we cannot guarantee the availability of stock. When Goods are no longer available after you have placed an order, Gobal Unique Fabrics will notify you and you will be entitled to a refund of any amount already paid by you for such Goods.

Delivery of Goods

Global Unique Fabrics offers 2 (two) methods of delivery of Goods to you. You may elect delivery via:
courier or self-collection
After accepting your order and payment, Global Unique Fabrics will deliver the Goods to you as soon as reasonably possible, but no later than 30 (thirty) days of receipt of your payment (“Delivery Period”). We will notify you if we are unable to deliver the Goods during the Delivery Period. You may then, within 7 (seven) days of receiving such notification elect whether or not to cancel your order for the Goods. If you elect to cancel your order, we will reimburse you for the purchase price.
Global Unique Fabrics obligation to deliver a product to you is fulfilled when we deliver the product to the physical address nominated by you for delivery of the order. Global Unique Fabrics is not responsible for any loss or unauthorised use of a product, after it has delivered the product to the physical address nominated by you

Errors

We shall take all reasonable efforts to accurately reflect the description, availability, purchase price and delivery charges of Goods on the Website. However, should there be any errors of whatsoever nature on the Website (which are not due to our gross negligence), we shall not be liable for any loss, claim or expense relating to a transaction based on any error, save – in the case of any incorrect purchase price – to the extent of refunding you for any amount already paid, or otherwise as set out in the Returns Policy.

Privacy policy

We respect your privacy and will take reasonable measures to protect it, as more fully detailed below.
Should you decide to register as a user on the Website, we may require you to provide us with personal information which includes but is not limited to –

your name and surname;
your email address;
your physical address;
your gender;
your mobile number; and
your date of birth.

Should your personal information change, please inform us and provide us with updates to your personal information as soon as reasonably possible to enable us to update your personal information.

You may choose to provide additional personal information to us, in which event you agree to provide accurate and current information, and not to impersonate or misrepresent any person or entity or falsely state or otherwise misrepresent your affiliation with anyone or anything.

Global Unique Fabrics will not, without your express consent:

use your personal information for any purpose other than as set out below:

In relation to the ordering, sale and delivery of Goods;

to contact you regarding current or new Goods or services or any other goods offered by us or any of our divisions, affiliates and/or partners (unless you have opted out from receiving marketing material from us);
to inform you of new features, special offers and promotional competitions offered by us or any of our divisions, affiliates and/or partners (unless you have opted out from receiving marketing material from us); and
to improve our product selection and your experience on our Website by, for example, monitoring your browsing habits, or tracking your sales on the Website; or
disclose your personal information to any third party other than as set out below:
to our employees and/or third party service providers who assist us to interact with you via our Website, email or any other method, for the ordering of Goods or when delivering Goods to you, and thus need to know your personal information in order to assist us to communicate with you properly and efficiently;
to our divisions, affiliates and/or partners (including their employees and/or third party service providers) in order for them to interact directly with you via email or any other method for purposes of sending you marketing material regarding any current or new goods or services, new features, special offers or promotional items offered by them (unless you have opted out from receiving marketing material from us);
to law enforcement, government officials, fraud detection agencies or other third parties when we believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report or support the investigation into suspected illegal activity, or to investigate violations of these Terms and Conditions;
to our service providers (under contract with us) who help with parts of our business operations (fraud prevention, marketing, technology services etc). However, our contracts dictate that these service providers may only use your information in connection with the services they perform for us and not for their own benefit;
to our suppliers in order for them to liaise directly with you regarding any faulty Goods you have purchased which requires their involvement.

We are entitled to use or disclose your personal information if such use or disclosure is required in order to comply with any applicable law, subpoena, order of court or legal process served on us, or to protect and defend our rights or property. In the event of a fraudulent online payment, Global Unique Fabrics is entitled to disclose relevant personal information for criminal investigation purposes or in line with any other legal obligation for disclosure of the personal information which may be required of it.

Linking to third party websites

This Website may contain links or references to other websites (“Third Party Websites”) which are outside of our control, including those of advertisers. These Terms and Conditions do not apply to those Third Party Websites and Global Unique Fabrics is not responsible for the practices and/or privacy policies of those Third Party Websites or the “cookies” that those sites may use.
Notwithstanding the fact that the Website may refer to or provide links to Third Party Websites, your use of such Third Party Websites is entirely at your own risk and we are not responsible for any loss, expense, claim or damage, whether direct, indirect or consequential, arising from your use of such Third Party Websites or your reliance on any information contained thereon

Payment

We are committed to providing secure online payment facilities. All transactions are encrypted using appropriate encryption technology.

Payments can be made for Goods via –

debit card;
credit card: where payment is made by credit card, we may require additional information in order to authorise and/or verify the validity of payment. In such cases we are entitled to withhold delivery until such time as the additional information is received by us and authorisation is obtained by us for the amounts. If we do not receive authorisation your order for the Goods will be cancelled. You warrant that you are fully authorised to use the credit card supplied for purposes of paying the Goods. You also warrant that your credit card has sufficient available funds to cover all the costs incurred as a result of the services used on the Website;
direct bank deposit or electronic funds transfer: if you pay via direct bank deposit or electronic funds transfer, payment must be made within 5 (five) days of placing your order. Global Unique Fabrics will not accept your order if payment has not been received.

Standard Returns Policy

We want you to be happy with your purchase. If you are not completely satisfied, you can return the product to us and we will either repair/replace it, or credit your account, subject to the below terms.

Preparing your products for a return
To ensure your request is processed as quickly as possible you are responsible for the following when returning your products;
package your products safely and securely for protection during transit;
clearly mark your return reference number on the outside of the parcel; and include all accessories and parts that were sold with the product.
In the same condition it was once was when it left our premise (Fish Hoek and Tokai branches)
In line with Industry Standards, once an item has been altered in any way which may include but are not limited to (Pre-wash, Cutting, Marking, Sewing) we will not refund or replace the item
Failure to adhere to any of these requirements could delay the processing of your request or result in its decline altogether.

Unwanted products

You can return an unwanted product to us, provided:

it is undamaged and unused, with the original labels and stickers still attached;
it is not missing any accessories or parts;
you request a return within 14 days of delivery to you or collection by you of the unwanted product. After 14 days, you can
only return a product if it is defective.
Once we have inspected the product and validated your return, we will credit your account with the purchase price of the product within 10 days of the return (or refund you if that is your preference). Please note that due to Covid-19 regulations, we may not refund certain products due to contamination purposes – see list of items concerned.

Returning an Item Instore

When returning an item instore, you are requested to bring your purchase receipt as proof of purchase. If you are unable to locate or bring your receipt with you, we ask that you contact Global Unique Fabrics by way of emailing us at info@globalfabrics.co.za and provide details of the transactions by providing a description of the said products, the time and date that the purchase was made. We will contact you once we have located your transaction via our point of sale systems so that you may drop off the product and receive your refund. Failing to do this, may result in waiting instore or not being able to receive your refund that day.

Not what you ordered?

If we accidentally deliver the wrong product to you, or if the product is not as described on the Website, please notify us and we will collect the product from you at no charge. If the product is missing any accessories or parts, you will need to follow the process set out in section 2 below. Once we have inspected the product and validated your return, we will at your choice deliver the correct product to you as soon as possible (if the correct product is available); or credit your account with the purchase price of the product within 10 days of the return (or refund you if that is your preference).

Products damaged on delivery

Should a product be damaged or missing any parts or accessories at the time of delivery / collection, please notify us within 7 days of such delivery / collection by logging a return on the Website.

We will arrange to collect the product from you at no charge. Once we have inspected the product and validated your return, we will at your choice repair / replace the product as soon as possible (if such repair is possible/ we have the same product in stock to use as a replacement) or credit your account with the purchase price of the product (or refund you if that is your preference).

Defective products

We do our best to ensure that the products we deliver to you are of a high quality, and in good working order and without defects.

What is a defect? A defect is a material imperfection in the manufacture of a product or any characteristic of a product, which makes the product less acceptable than one would reasonably be entitled to expect in the circumstances. Please refer to our FAQs for some examples.

The following will NOT be regarded as defects and will not entitle you to a return under this section 3:

faults resulting from normal wear and tear;
damage arising from negligence, user abuse or incorrect usage of the product;
damage arising from electrical surges or sea air corrosion;
damage arising from a failure to adequately care for the product;
damage arising from unauthorized alterations to the product;
where the specifications of a product, although accurately described on the Website and generally fit for its intended purpose, do not suit you

Competition Rules

Prizes may not be exchanged for cash.
Should any of the prizes not be redeemed within one month Global Unique Fabrics reserves the right to select an alternative winner who is available to redeem the prize.
Draws will take place on the date specified on each competition
If the prize is of monetary value, the voucher will be presented in the form of a loyalty card of which the funds will placed upon, this will automatically qualify you as a loyalty member.
The winner will be required to provide Global Unique Fabrics with their personal particulars for record keeping purposes.
Global Unique Fabrics is not responsible for the loss, misuse of, or damage to any of the prizes after they have been handed over to the winners.
Global Unique Fabrics may withdraw from the competition if circumstances beyond their control prevent them from continuing with the competition or due to fraudulent or criminal activities. If this occurs, consumers will be notified and advised of alternate arrangements.

Use of the Website

These website terms and conditions (“terms and conditions”) govern the ordering, sale and delivery of goods, and the use of this website.

These terms and conditions are binding and enforceable against every person that accesses or uses this website (“you”, “your” or “user”),

By using this website you acknowledge that you have read and agree to be bound by these terms and conditions.

By using the Website you warrant that you are 18 (eighteen) years of age or older and of full legal capacity. If you are under the age of 18 (eighteen) or if you are not legally permitted to enter into a binding agreement, then you may use the Website only with the involvement and supervision of your parent or legal guardian. Conclusion of sales and availability of stock

Once you register, you may place orders for goods, which Global Unique Fabrics may accept or reject. Whether or not Global Unique Fabrics accepts an order depends on the availability of the goods, correctness of the information relating to the goods (including without limitation the price) and receipt of payment or payment authorisation by Global Unique Fabrics for the goods.

NOTE: Global Unique Fabrics will indicate the acceptance of your order by delivering the goods to you (at your cost) or allowing you to collect them (at your cost) , and only at that point will an agreement of sale between you and Global Unique Fabrics come into effect (“the sale”). This is regardless of any communication from Global Unique Fabrics stating that your order or payment has been confirmed. Global Unique Fabrics may cancel or reject a confirmed order and will indicate the rejection of your order by canceling it and, as soon as possible thereafter, refunding you for any amount already paid.

Prior to delivery or your collection of the goods, you may cancel an order at any time provided you do so before receiving a dispatch or delivery notice, should you wish to cancel after dispatch or delivery notice has been received, there is a 15% cancelation fee (Please refer to our cancelation policy). After delivery or your collection of the goods, you may return the goods only in accordance with the Returns Policy.

Placing Goods in a wish list or shopping basket without completing the purchase cycle does not constitute an order for such goods, and as such, goods may be removed from the shopping basket if stock is no longer available or the price thereof might change without notice to you. You cannot hold Global Unique Fabrics liable if such goods are not available or are not available at the particular price when you complete or attempt to complete the purchase cycle at a later stage.

You acknowledge that stock of all goods on offer is limited and that pricing may change at any time without notice to you. In the case of goods for sale by Global Unique Fabrics, Global Unique Fabrics will take all reasonable efforts to monitor stock levels and ensure that when stock is no longer available, that offers thereof are discontinued on the website. However, we cannot guarantee the availability of stock. When goods are no longer available after you have placed an order, Global Unique Fabrics will notify you and you will be entitled to a refund of any amount already paid by you for such Goods.

In our efforts to provide prompt, cost effective and efficient services to all our customers, we will regrettably not accept orders for cutting of fabric, if, in the opinion of management, it will result in a disproportionate use of resources, and/or increase the risk of error to an unacceptable degree

Payment

Payment can be made for goods via, Secured Payment Gateway (Payfast), direct bank deposit, electronic funds transfer into our bank account.

NOTE: If you pay via direct bank deposit or electronic funds transfer, payment must be made within 48 hours of placing your order, order will state Pending Payment until Payment and Proof of Payment has been received only then will your order status will changed to Processing. Only once we have received payment will your Order be Processed (Fabric/Haberdashery cut to specifications)

Global Unique Fabrics will not accept your order if payment has not been received within 48 hours, should payment not be received, orders will be canceled and stock packed back to the shop shelves.

Errors

Subject to clauses 1 and 2 under the header Changes to these terms and conditions , and in respect of transactions already concluded – no variation, addition, deletion, or agreed cancellation of the Terms and Conditions will be of any force or effect unless in writing and accepted by or on behalf of the parties hereto.

No indulgence, extension of time, relaxation or latitude which any party (the “grantor”) may show grant or allow to the other (the “grantee”) shall constitute a waiver by the grantor of any of the grantor’s rights and the grantor shall not thereby be prejudiced or stopped from exercising any of its rights against the grantee which may have arisen in the past or which might arise in the future.

These terms and conditions contain the whole agreement between you and Global Unique Fabric Concepts CC and no other warranty or undertaking is valid, unless contained in this document between the parties.

Governing law

These terms and conditions and our relationship and/or any dispute arising from or in connection with these terms and conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa.

Nothing in this clause or the terms and conditions limits your right to approach any court, tribunal or forum of competent jurisdiction in terms of the CPA.

Shipping Policy

Currently, delivery is only available within South Africa

You are liable for the costs of delivery.

A courier fee quotation will be included in your final invoice based on location of shipping address

Global Unique Fabric’s obligation to deliver a product to you is fulfilled when we deliver the product to the physical address nominated by you for delivery of the order.

Lead Times

Lead times may vary, should we have our order in stock and on hand your order will be sent out same day however should be need to order stock to fulfill your online order, the average lead time is between 3 – 4 business working days, we will always endeavor to communicate with you any delays and keep you informed, we work with 3rd party suppliers and as such there can be unforeseen delays.

Returns Policy

This returns policy forms part of the terms and conditions, and so words defined in the terms and conditions have the same meaning in this policy, unless the context indicates otherwise. Nothing in this policy is intended to limit your statutory rights in any way.

General terms applicable to returns, exchanges and refunds

The provisions of the CPA apply to returns / exchanges and refunds, and goods will only be returned /exchanged or refunded if they qualify for return/refund or exchange in terms of these terms and conditions read with the CPA.

Your attention is drawn to the fact that, except as otherwise provided in these terms and conditions and in the CPA, returns will not be accepted in respect of goods that, after having been supplied to you, or at your direction, have been partially or entirely dissembled, physically altered, permanently installed, fixed, attached, joined or added to, blended or combined with, or embedded within other goods or property.

Refunds will be made subject to any deductions that are applicable in the CPA.

Where returns qualify and are applicable in terms of the CPA, a reasonable charge will be levied for use of the goods during the time they were in your possession, any consumption or depletion of the goods and for restoration costs to render the goods fit for re-stocking.

Refunds and / or exchanges will not be entertained unless you produce an original tax invoice generated from the online store.

If you change your mind

Where you have changed your mind and would like a credit for a product, you can return it within 7(seven) days of delivery or collection – provided the product is not a product which has been personalised for you or made or cut to your specifications.

In this regard, once we have inspected the product and validated your return, we will refund you .

PLEASE NOTE: You will be responsible/liable for the direct cost of returning the product (i.e. you will be liable for the arrangement/booking of returning the items to us as well as any applicable fee for courier or transport thereof), as well as a 15% cancellation fee, in lieu of administration and handling of your order.

If the product is personalised and/or is a product referred to in the section “Fabric and haberdashery that are cut to your specifications” below, returns arising from you changing your mind will not be accepted

Defective Products

If you have received a product which turns out to be defective or otherwise of poor quality ,and you wish to return the product, you must notify us as soon as reasonably possible after you become aware of the defect or poor quality, but in any event within 6 months after delivery / collection of the product

The following will NOT be regarded as defects and will not entitle you to a return under this section

2.1 damage resulting from normal wear and tear;

2.2 damage arising from negligence, user abuse or incorrect usage of the product;

2.3 damage arising from a failure to adequately care for the product;

2.4 damage arising from unauthorized alterations to the product; and

2.5 where the specifications of a product, although accurately described on the website and generally fit for its intended purpose, do not suit you

Fabric and haberdashery that are cut to your specifications

Fabric and some haberdashery items (“cut haberdashery items”) are cut from rolls based on your specific requirements/request and have a negligible or no re-saleable value to Global Unique Fabrics once cut.

Consequently you acknowledge and agree that a despatch notice by us to you confirming that your order for a specific quantity of fabric from a roll or a specific quantity of a cut haberdashery item has been despatched shall be deemed to constitute a sale of such quantity of fabric or cut haberdashery item to you, at the displayed or marked price.

You will accordingly be liable in such circumstances to pay the full purchase price for the fabric or cut haberdashery item.

Please note that no returns of cut fabric and cut haberdashery will be entertained unless they qualify for return and/or refund in accordance with these terms and conditions and the CPA.

Clearance goods

Clearance goods are clearly stated as such and contain a description of the condition of the goods.

By purchasing such goods, you:

2.1 acknowledge that you have been informed by us that the clearance goods are offered in the condition described, and

2.2 agree to accept such goods in the condition described

Conclusion of sales and availability of stock

NOTE: Global Unique Fabrics will indicate the acceptance of your order by delivering the goods to you (at your cost) or allowing you to collect them (at your cost), and only at that point will an agreement of sale between you and Global Unique Fabrics come into effect (“the sale”). This is regardless of any communication from Global Unique Fabrics stating that your order or payment has been confirmed. Global Unique Fabrics may cancel or reject a confirmed order and will indicate the rejection of your order by cancelling it and, as soon as possible thereafter, refunding you for any amount already paid.

Prior to delivery or your collection of the goods, you may cancel an order at any time provided you do so before receiving a dispatch or delivery notice please note, should you received a dispatch or delivery notice, you will be charged a 15% cancellation fee. After delivery or your collection of the goods, you may return the goods only in accordance with the Returns Policy.
